Five years after recovery, former cancer and hepatitis C patients will be able to get a mortgage on the same terms as all borrowers. This provision will be extended to other chronic diseases. This is what the law provides for fairer, simpler and more transparent access to the insurance market for borrowers. The law also removes the medical questionnaire for loans below € 200,000. It also establishes the termination of the borrower’s insurance at any time.
Published in Official newspaper from 1uh March 2022, the law for fairer, simpler and more transparent access to the insurance market of the borrower simplifies the loan conditions for the purchase of real estate for former cancer and hepatitis C patients: five years after the end of their therapeutic protocol ( active treatment phase), and in the absence of a relapse, they will no longer have to declare this history of illness to their insurer. Previously this right to be forgotten it was ten years, except for cancers discovered before age 21, for which it was already five years.
This new provision will allow these people to more quickly find borrower insurance conditions identical to those of all borrowers and thus reduce the cost of their loan. It will be extended to other chronic diseases, such as diabetes, as part of the negotiations between the signatories of the AREA convention (Insurance and borrow with aggravated health risk) which brings together the State, professional insurance federations and banks, patient and consumer associations. In the absence of an agreement, this extension will be fixed by decree in the Council of State no later than 31 July 2022.
On the other hand, for the below loans € 200,000 for policyholder and whose repayment term occurs before the borrower turns 60, the borrower insurance health questionnaire is removed. No medical examination of the insured person can be requested by the insurer.
These measures come into force on 1uh June 2022.
Cancel and change the borrower’s insurance at any time you can
The law of February 28, 2022 also opens up the possibility of terminating and modifying everytime borrower insurance, free of charge. Several texts had progressively allowed this solution to facilitate the renegotiation of insurance conditions to benefit from a better rate, but it was still little used by those who had taken out a mortgage.
This measure applies from 1uh June 2022 for new loans, and from 1uh September 2022 for contracts in progress on that date. Each year, insurers must inform their policyholders of this right of withdrawal. They will also have to disclose the cost of the borrower’s insurance for eight years.
To notice : This law aims at ” put an end to the unfair discrimination suffered by many borrowers who have been or are still sick “, underlines the Senate. In fact, depending on the history and chronic diseases of the borrowers, the rates can reach very high amounts, even completely dissuasive to consider a real estate acquisition project.
